NOTICE OF HEARING
TO WHOM IT MAY CONCERN:
In compliance with the pertinent provisions of the Borough of West Cape May Zoning and Land Development Ordinance, and the New Jersey Municipal Land Use Act, N.J.S.A. 40:55D-1 et seq., notice is hereby given that a written application has been filed with the Borough of West Cape May Planning / Zoning Board seeking a waiver of site plan review and a favorable interpretation of the Borough of West Cape May Zoning Ordinance pursuant to N.J.S.A. 40:55D-70(b) in connection with the establishment of a bed and breakfast within the existing structure located at 846 Broadway, West Cape May, New Jersey.
The site is presently improved with a structure containing three (3) units and accessory storage. Unit A is located on the first floor and is currently utilized as a professional office. Unit B is also located on the first floor and is presently vacant. Unit C comprises the second and third floors and is utilized as a residential dwelling. The Applicant proposes to convert Unit B into a bed and breakfast use for transient accommodation. The Applicant seeks a favorable interpretation that the proposed use constitutes a bed and breakfast. No structural expansion or alteration of the building or site layout is proposed as part of this conversion.
The Applicant is also seeking any and all other variances or waivers the Board may reasonably require in the exercise of its discretion, and without further public notice. In the alternative, the Applicant seeks use variance relief pursuant to N.J.S.A. 40:55D-70(d)(1) to permit transient accommodations within Unit B of the subject premises.
The above relief concerns property located at 846 Broadway, Block 55, Lot 1.01, as shown on the Borough of West Cape May Municipal Tax Map. The subject property is located within the C-1 Broadway Commercial Zoning District.
Public hearing on the above-mentioned application has been scheduled for June 2, 2026, at 6:30 p.m. located at the West Cape May Municipal Building, Court Room, 732 Broadway, West Cape May, New Jersey, Cape May County, New Jersey 08204, at which time and place any interested party (as defined in N.J.S.A. 40:55D-4) will have an opportunity to be heard.
Please take notice that the Board may, in its sole and absolute discretion, adjourn, postpone or continue said hearing from time to time by providing oral notification at the time of the hearing and without requiring the publication or service of further notices and you are hereby notified that you should make diligent inquiry of the Office of the Board Secretary concerning such adjournments, postponements or continuations.
All documents relating to this application may be inspected by the public during regular business hours in the Office of the Board Secretary, West Cape May Municipal Building, 732 Broadway, West Cape May, New Jersey, Cape May County, New Jersey 08204.
